Massive Expansion of Government Involvement in Health Care Passed by House
E2SSB 5930, which implements the recommendations of the Blue Ribbon Commission on Health Care Cost and Access, included vital reforms to the small group market that would have allowed lower cost, more flexible health plans for small businesses when it unanimously passed the Senate. Unfortunately, the small group reforms were removed from the bill in the House, and the bill is now a blueprint for a massive and expensive expansion of government involvement in health care. This measure was passed by the House and now must be reconciled with the Senate’s version of the bill. Contact your senator and representative and urge them not to vote for the bill unless it is restored to the Senate version. Paid Family Leave Bill Approved by House
The Paid Family Leave Bill (SB 5659) passed the House on a largely party-line vote, granting five weeks of paid leave at $250 per week for maternity or bonding leave. A task force of legislators, labor, and business is set up to figure out how to finance and administer the program before it begins in October 2009. The Senate has to concur before the bill goes to the governor's desk. AWB opposed this burdensome measure and is disappointed in its passage. Eminent Domain Abuse Protection Bill Passes Senate
HB 1458, which addresses the inadequate notice issue raised in Central Puget Sound Regional Transit Authority v. Miller, requires at least 15 days of public notice prior to any public meeting that will make a final decision on property condemnation. Notices must be sent to impacted property owners by certified mail and published in local newspapers. Failing to provide sufficient notice would void condemnation decisions affecting the specific individuals who were not properly notified. This bill has passed the Senate and has been delivered to the governor for signature. Natural Gas B&O Tax Exemption Approved by Senate, Sent to Governor

Puget Sound Partnership Process Moving Forward – Nominations Requested
With the recent passage of SB 5372 by the House (which creates a new state agency called the Puget Sound Partnership), the governor is expected to sign the bill within the next few weeks. The governor’s office has requested nominations for several of the positions created by the new agency including the seven-member Leadership Council, the Executive Director and the Ecosystem Coordinating Board. House Gives Green Light to Frivolous Lawsuits, Higher Insurance Rates
SB 5726, known as the “Insurance Fair Conduct Act,” will prohibit insurance companies from unreasonably or negligently denying a claim for coverage or payment of benefits to an insured. A plaintiff successfully proving a violation through a legal challenge may be awarded up to three times the original claim amount plus legal expenses. Although AWB strongly opposed this measure because it would encourage frivolous lawsuits against insurers, this bill was unfortunately approved by the House. It is now on its way to the governor. AWB Pleased with Industrial Land Bank Bill’s Approval in the SenateAWB-backed HB 1965, which amends the process of master planned locations for industrial developments, recently passed the Senate. Overturning a recent Growth Management Hearings Board ruling, the bill permits a two step process: 1) designation of an industrial land bank in the comprehensive plan, and 2) subsequent approval of specific major industrial developments through a local master plan process. Climate Change Bill Passes House – Heads to the Senate for Concurrence
By a vote of 83-14, the House passed SB 6001, which codifies the governor’s climate change executive order goals and places new greenhouse gas performance requirements on utilities. AWB opposed earlier versions of the bill, arguing that it is premature to implement substantive greenhouse gas policies ahead of the climate stakeholder process discussions currently underway, especially given Washington’s relatively low greenhouse gas emissions. AWB members representing industrial customers and utilities were able to reach a compromise on the final bill, minimizing potential impacts to the economy. Unfortunate Workers’ Comp Bill Passed by House
SB 5676, which will allow the prior closure of claim to not affect the entitlement to loss of earning power benefits, has been approved by the House in spite of AWB’s opposition. Electrical Transmission Measure Approved by Senate
HB 1037 creates an opt-in provision for applicants seeking Energy Facility Siting and Evaluation Council (EFSEC) jurisdiction over multi-jurisdictional electrical transmission facilities of at least 115 kilovolts. AWB supported this legislation following the passage of Initiative 937 (Renewable Energy Mandates) last fall. This bill will provide additional electricity transmission capacity for wind, hydro and other forms of power in rural parts of the state to the urban centers where more power is needed. “Pay or Play” is Back – Will its Supporters Ever Learn?HB 2094, the latest so-called “fair share” health bill would slap a B&O surcharge on retailers with 1,000 or more employees. If the retailer spends 9 percent of their payroll on health care, the B&O surcharge is removed. The bill is burdensome on businesses, which would not be allowed to make hiring/firing decisions based on whether an individual is on Medicare or the state’s Basic Health Insurance. “Pay or play” health care schemes, like this one, are on shaky legal grounds. Already, “pay or play” legislation passed in Maryland has been thrown out of federal court as an ERISA violation. When will “pay or play” supporters ever learn? Bill to Radically Expand Definition of Disability Passed by House
In spite of AWB’s opposition, the House has approved SB 5340. This measure will overturn the State Supreme Court’s McClarty v. Totem Electric decision by rewriting state law against discrimination. Changes to Office of Regulatory Assistance Approved in House
SB 5122, which was strongly supported by AWB, eliminates the sunset date of the ORA and continues the office until June 30, 2012. The ORA helps individuals and businesses by answering permitting questions and provides access to information about state regulations. In addition, ORA assists with coordinating between the layers of state, local, and federal permit review. The bill has been approved in the House and delivered to the governor. Maury Island Aquatic Reserve Bill Appears Dead this Session
SB 6011 would create a Maury Island Aquatic Reserve and prohibit Glacier Northwest’s proposed barge transportation dock on the island. A majority of legislators agree with AWB that this bill would greatly increase construction costs for the region’s public works and compound our state’s traffic congestion problems by requiring sand and gravel to be transported by truck from much farther distances.
